You are expected to make an informed decision about your purchase BEFORE you buy your Nutshell product.
Nutshell will do everything possible to make sure that you are
satisfied with your purchase decision but we shall not held responsible
for incorrectly purchased products that do not meet the use for which
you intended.
Nutshell WILL refund the product cost back to your credit card, at our stated dollar value, on receipt of your product back into our warehouse.
Unless we have made a mistake, Nutshell WILL NOT refund your Postage and Packaging charge.
The cost of returning any product to us for a refund or exchange is your responsibility.
We will only credit you the product cost when we have received your product back into our store.
If you purchase a Nutshell product and find it is not correct, in the first instance we expect you to contact us immediately to let us know that you consider the product is wrong or not what you ordered.
If you promise to ship us back the wrong product by regular mail, we will immediately ship you out a replacement product.
If we do not get the incorrect product back, we reserve the right to charge you for the replacement.
Failure to contact us as soon as possible and advise us of any problems
does not release you, as a Customer, from any statutory obligations
toward us as a Merchant.
Nutshell reserves its rights to exercise its status as an approved
Internet Merchant to the full extent of the law to reclaim goods that
are not fully paid for.
Any costs incurred by Nutshell to get full payment for its products,
and/or the costs of reclaiming goods that are delivered and
subsequently not paid for will be the sole responsibility of the
Customer.
Your decision to purchase a Nutshell product indicates that you agree to the Terms of Trade as outlined above.
Failure to read this information will not be accepted as a reason for not understanding our Terms of Trade.
The liability of Nutshell in
respect of any claim or action by the Customer for any remedy or
compensation for any loss, injury, costs, expenses or damage
(including, without limitation, consequential loss or indirect damages)
arising directly or indirectly out of the supply of products or
services by Nutshell to the Customer, or the failure by Nutshell to
supply products or services in accordance with the Terms of Trade, or
otherwise in connection with the products or services or any advice,
recommendation, information or services provided by Nutshell,
including, without limitation, any claim or action based on any
conditions, warranties, descriptions or representations whether
expressed or implied by law, trade custom or otherwise is limited to:
(a) the replacement of product; or
(b) the cost of the products or services ;
at the option of Nutshell.
